This competition “Santa Sézane” (the “Competition”) is governed exclusively by the laws of France. Void where prohibited by law.

1. Dates of Competition : The Competition begins on Monday, December 2nd, 2024 at 06:00 pm Central European Time (CET) and ends on Monday, December 31th, 2024 at 06:00 pm CET (the “Competition Period”).

2. Sponsor: Benda Bili, doing business as “Sézane”, is a French Company with a share capital of €27,386, registered at the Paris Trade Registry under the number 534 652 854, located at 115 rue du Bac – 75007 Paris, France, which designs and sells top of the range clothes and accessories for women (hereinafter “Sézane”).

3. Eligibility: The Competition is open to all TikTok users, who have reached the age of majority in their own state as of the date of entry and have access to an internet connection and a valid email address. Officers, directors, and employees of Benda Bili, or its affiliates, and related companies, and the immediate family members (parents, children, siblings, spouse) or members of the same household (whether related or not) of such officers, directors, and employees are not eligible to participate in the Competition (the “Participants”).

At the time Winners are declared, Sézane reserves the right to ask any Participant to justify these conditions. Any Participant who does not meet these conditions or refuses to justify them will be excluded from the Competition and will not be able, in the event of a win, to benefit from the Prize. Similarly, any false declaration, indication of identity or address will result in the immediate elimination of the Participant.

4. Agreement to Rules: By participating in the Competition, you, the Participant, fully and unconditionally agree to be bound by these Official Rules and the decisions of Sézane, which will be final and binding in all matters relating to the Competition.

5. How to enter: To be able to participate in the Competition and have a chance to win the “Prize” (as defined below), Participants must on TikTok:

- follow account @sezane 

- like day's or previous day's post relating to the Competition on the @sezane account, and

- tag two (2) other TikTok users on the day's or previous day's post relating to the Competition.

Participants must ensure that they obtain the consent of the other users before any publication or disclosure of their personal data (TikTok pseudonym), when participating in the Competition. Sézane decline any liabilities related to such sharing without consent.

Entries before or after the Competition Period will not be taken into account. Participants can only participate once per post relating to the Competition during the Competition Period. Any registration by telephone, fax, postal mail cannot be taken into account.

6. Prize: The Prize described below will be awarded to one (1) Winner (as defined below), each Tuesday during the Competition Period - a total of five (5) Winners who meet the Terms and Conditions of participation.

The Prize consists of one (1) Sézane voucher to the unit value of three hundred euros (€300) including all taxes - or the equivalent in the currency applicable on the website www.sezane.com to the Winners’ place of residence - to be used on the www.sezane.com website and in Sézane boutiques, excluding Sézane corners in department stores or on the www.octobre-editions.com website and in Octobre Editions boutiques, excluding corners in department stores.

The Prize is personal, cannot be exchanged or refunded in cash. If the Prize is not used during its validity period of six (6) months from the date of issue, the Winners will lose the Prize and it will remain acquired to Benda Bili. 

The Prize is awarded “as is” with no warranty or guarantee, either express or implied. The right to receive the Prize is not transferable, and no substitutions or cash equivalents are permitted except at Sézane sole discretion or as otherwise provided herein. Sézane will not replace the Prize, if it is lost or stolen or canceled. Any and all Prize-related expenses, including without limitation any and all federal, state, and local taxes, shall be the sole responsibility of the Winners.

7. Winners selection and notification: One (1) Winner will be selected by Sézane by random draw on Tuesday December 3rd 2024, Tuesday December 10th 2024, Tuesday December 17th 2024 and Tuesday December 24th 2024 and Tuesday December 31st with the software Sorteos from the list of Participants who adhere to the conditions mentioned in Articles 3 and 5 (the “Winners”), a total of five (5) Winners. 

Selected Winners will be announced each Tuesday during the Competition Period, in the comment section of the TikTok post relating to the Competition from the previous day .

The Winners will be notified via TikTok direct message. In order to receive the Prize, the Winners must reply to communicate with Sézane's team to set the delivery conditions of the Prize. If a potential Winner fails to timely respond or is found to be, in Sézane's sole discretion, ineligible or in violation of these Official Rules, such potential Winner and his/her entry will be disqualified, and an alternate Winner will be selected from all remaining eligible entries. 

The Prize will be sent to the Winners within seven (7) days of receipt by Sézane of the completed personal contact details. The receipt of the Prize offered in this Competition by the Winners is conditional upon compliance with any and all federal and state laws and regulations.

As a result of the acceptance of the Prize, the Winners authorize Benda Bili / Sézane to use their name, first name, city of residence, TikTok pseudonym on all media known or unknown to date, in particular the internet and social networks, without this use being able to give rise to any consideration other than the Prize won, for the purposes of promoting the results of the Competition.

SÉZANE CANNOT BE HELD RESPONSIBLE FOR DELAYS, LOSSES, DAMAGE OR MALFUNCTIONS OF THE POSTAL SERVICES, THE INTERNET OR THE MESSAGING SYSTEM, WHICH OCCURRED DURING THE DELIVERY OF THE PRIZE.

8. Processing of personal data: In accordance with Law No. 78-17 of January 6th, 1978, and the General Data Protection Regulation (GDPR), Benda Bili is responsible for processing for this Competition. The personal data requested from Participants and Winners is necessary to manage participation and the awarding of the Prize. This data includes the Participant's identity data and contact data and is processed in accordance with the Privacy Policy available at www.sezane.com.

Benda Bili undertakes to protect the confidentiality and security of personal data to prevent unauthorized access. Access is limited to staff and service providers involved in the management of the Competition. Benda Bili will not sell, rent or transfer data to third parties without consent, unless required by law.

Personal data will be kept until the end of the Competition and the awarding of the Prize, unless the Participant requests the deletion of his/her data, which would result in his/her exclusion from the Competition; if a longer retention period is required by law, or if the Participant gives his/her consent by opting-in to the Sézane newsletter subscription.

In accordance with regulations, the Participant has the right to access, rectify, delete, oppose and limit the processing of his/her data.

9. General Terms: Decisions made by Sézane are final in all matters, including interpretation of these Official Rules and awarding of the Prize. Participants assume all risk of loss, damage, destruction, delay, or misdirection of Competition materials submitted to Sézane. Sézane reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Competition, or any part of it, if any virus, bugs, other technical failures, non-authorized human intervention, fraud, or any other causes beyond Sézane's control impair the administration, security, integrity, or proper functioning of the Competition, as determined by Sézane in its sole discretion. Sézane at its sole discretion reserves the right to disqualify any Participants it finds to be tampering with or attempting to tamper with the entry process or the operation of the Competition or to be acting in violation of these Official Rules. 

Any attempt by a Participant to deliberately damage or undermine the legitimate operation of the Competition may be a violation of criminal and civil laws, and, should such an attempt be made, Sézane reserves the right to seek damages from any Participant to the fullest extent permitted by law. 

Sézane failure to enforce any term of these Official Rules shall not constitute a waiver of that term. By participating in the Competition, the Participant, fully and unconditionally agrees to respect all the TikTok terms of use of the website available at https://www.tiktok.com/legal/page/us/terms-of-service/en. 

10. Release: By participating in the Competition, Participants agree to release from liability and hold harmless Sézane, its parent company, affiliates, and related companies, and each of their respective officers, directors, and employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Competition or the receipt or use or misuse of any Prize.

11. Limitation of Liability: Sézane is not responsible for: (1) any incorrect or inaccurate information, whether caused by Participant, printing errors, or any of the equipment or programming associated with or utilized in the Competition; (2) technical failures of any kind, including, but not limited to, malfunctions, delays, interruptions, or disconnections in phone lines or network hardware or software; (3) technical or human error which may occur in the administration of the Competition or the processing of entries; (4) late, lost, undeliverable, damaged, stolen, misdirected, or postage-due entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by Participant’s participation in the Competition or receipt or use or misuse of any Prize.

12. Disputes: This Competition is governed by the laws of France without respect to conflict of law doctrines. As a condition of participating in this Competition, Participant agrees that any and all causes of action arising out of or connected with this Competition shall be resolved individually, without resort to any form of class action, exclusively before a court located in Paris, France. Further, under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than Participant’s actual out-of-pocket expenses, and Participant further waives all rights to have damages multiplied or increased.

13. Winners Names and Rules: To obtain a copy of the Winners’ names or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to Benda Bili at 115 rue du Bac – 75007 Paris, France. Residents of Vermont may omit return postage. Requests must be received no later than January 1st 2025.
